Terms of Service

Part A — Everyone who uses GoDig

1. What GoDig is — and is not

GoDig is an introduction service: a contractor ("hirer") posts a hire request, nearby member plant companies ("companies") send quotes, and when a quote is accepted the two parties are put in contact to deal direct. We are not a party to, and have no involvement in, any agreement, transaction or arrangement entered into between a hirer and a company. We do not own, operate, inspect, transport or insure any machine, we do not employ operators, we do not set or negotiate prices, and we do not take or hold payment for any hire. All pricing, invoicing, payment and payment disputes are strictly a matter between the hirer and the company. The hire contract — including rate, scope, transport, standby, fuel, deposits, insurance and liability — is concluded directly between them.

No agency. Nothing on GoDig creates an agency, partnership, employment or joint-venture relationship between GoDig and any user. GoDig does not select companies for a hirer, make representations on any user's behalf, or endorse any user — a listing, quote, rank, badge or message on the platform is not a recommendation, endorsement or validation by GoDig.

Delivery of messages. Requests, quotes and updates travel over the WhatsApp Business Platform (Meta) and email. We do not control and cannot guarantee the delivery, timing or uptime of those networks.

2. Safety, machinery and the law on site

Machinery is dangerous, and the hire happens entirely off our platform. GoDig is not the owner, lessor, employer or "user" of any machine as defined in the Occupational Health and Safety Act 85 of 1993 — those statutory duties sit with the parties to the hire, as allocated by that Act and their hire agreement. You use any machine, site, operator or counterparty found through GoDig at your own risk, and you are responsible for your own checks: the machine's condition, the operator's competence and certification, insurance, and site safety.

3. Vetting & the "Vetted" badge

⚠ What "Vetted" means — and what it does not

"Vetted" means we checked the company's registration documents (CIPC) and the identity of the person who signed up at a point in time. It is not a guarantee of insurance, financial standing, machine condition, operator competence, workmanship, or ongoing compliance — we do not inspect machines or job sites. A badge is an aid to your own judgement, never a substitute for it. GoDig is not responsible for the conduct of any company, vetted or not.

4. Quotes

A quote sent through GoDig is set entirely by the company: the rate, whether it includes an operator (wet/dry), and any transport or extra costs it states. Anything a quote does not state is agreed directly between the parties before the hire. Accepting a quote confirms the booking on the quoted basis and shares contact details both ways; a quote past its stated validity date cannot be accepted. GoDig adds nothing to the price — the quote is the price, 0% commission.

5. Reviews & content standards

Reviews must be honest and based on a real, confirmed booking, and are published double-blind (a review stays private until the other side has reviewed too, or 14 days pass). We may remove content that is abusive, fake, unlawful or unrelated to a real hire.

Disputing a review (take-down process): email info@godig.co.za with the subject "Review dispute", the booking reference, and the grounds (e.g. factually false, defamatory, no real hire). We acknowledge within 5 business days and decide within 10 business days; content we determine to be unlawful or in breach of these terms is removed. This is also our take-down address for the purposes of Chapter XI of the Electronic Communications and Transactions Act 25 of 2002.

6. Your content & licence

You keep ownership of what you submit (requests, quotes, reviews, photos, logos, documents). You grant GoDig a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, display and process that content for the purpose of operating, improving and promoting the service — for example showing your request to nearby companies, your quote to the hirer, or an anonymised rate in our market-rate statistics. Reviews may remain published after an account closes (they attach to the hire, not the account). Vetting documents are used only to verify you and are never published.

7. Acceptable use

Don't misuse the service: no fraud or misrepresentation, no fake requests or quotes, no scraping or bulk-harvesting of contact details, no spamming other users, no attempts to break security or rate limits, no unlawful content. We may suspend or remove accounts that do, and membership fees are not refunded on removal for misconduct.

8. Privacy

We handle personal information as set out in our Privacy Policy, in line with POPIA. Access-to-information requests are handled under our PAIA Manual. When you accept a quote (or a company's quote is accepted), the sharing of contact details both ways is a necessary part of performing this contract — it is the product.

9. Liability & indemnity

⚠ Important notice — limitation of liability & indemnity (s49 CPA)

To the maximum extent the law allows, GoDig is not liable for any loss or damage arising from a hire, a machine, an operator, a site, a quote, a review, a no-show, a payment or deposit made to another user, or any dealings between users — and is not liable for indirect or consequential loss of any kind (including loss of profit, loss of use, or project delay costs).

Cap: if we are held liable despite the above, our total aggregate liability to you is limited to the greater of (a) the fees you actually paid GoDig in the 6 months before the claim arose, or (b) R1,000.

What this never excludes: nothing in these terms excludes or limits liability for fraud or dishonesty, wilful misconduct, gross negligence, or any liability that cannot lawfully be excluded, and nothing limits rights you have under the Consumer Protection Act 68 of 2008 or other law that cannot be contracted out of.

Indemnity: you indemnify GoDig (PlantLynk (Pty) Ltd, its directors and staff) against claims by third parties arising from your use of the service, your content, your conduct in a hire, or your breach of these terms — except to the extent the claim is caused by our own fraud, wilful misconduct or gross negligence.

10. Disputes, law & general

Between users: disputes about a quote, a hire, payment or workmanship are between the hirer and the company — we may assist informally (and your report helps us police the platform) but we are not an arbiter of hire disputes.

With GoDig: talk to us first — email info@godig.co.za and give us 30 days to resolve it informally. If that fails, the dispute is referred to arbitration under the Expedited Rules of the Arbitration Foundation of Southern Africa (AFSA), seated in Pretoria, in English — without limiting either party's right to urgent relief from a competent court, or your right to approach a consumer tribunal or ombud with jurisdiction.

These terms are governed by the law of the Republic of South Africa. If any clause is found unenforceable, the rest stand. Where you contract with us as a natural-person consumer at a distance, statutory cooling-off rights under ECTA s44 (7 days) apply where the service has not yet been used. We may update these terms; the "last updated" date shows when, and material changes will be notified to members.

Part B — Hirers (free)

11. Your side of the deal

Posting requests and comparing quotes is free. In return: give accurate details (machine, dates, site), deal in good faith with companies that spend time quoting you, and tell us when plans change (cancel the request rather than going silent). Repeated no-shows or fake requests may lower your standing or end your access.

12. Your site, your duties

You are responsible for your site: safe access, ground conditions, permits, and compliance with the Occupational Health and Safety Act and local requirements. On dry hire, you supply and are responsible for a competent, certified operator.

13. Paying the company

⚠ Before you pay anyone

GoDig never asks you to pay for a hire, and never holds hire money. Any deposit or payment goes directly to the company at your own risk — never pay before you have confirmed the company's details and seen the machine (or solid proof of it). If anything feels off, don't pay, and report it to us on WhatsApp.

Part C — Member companies (paid membership)

14. Membership

Companies join on a monthly membership at the price published on our pricing page at the time you join (currently R495/month founding for the first 25 companies, locked at that rate; R950/month standard thereafter — your first quote is free). Membership puts your company in line to receive matching hire requests, ranked purely by distance — ranking is never sold. It is month to month — you can cancel at any time by messaging us on WhatsApp or emailing info@godig.co.za. Cancellation stops future billing and your membership runs to the end of the paid period; fees already paid are not refunded pro-rata for the unused part of a period, except where the CPA or ECTA requires otherwise. Payment is by EFT.

15. Your representations

By registering a company you confirm you are authorised to act for it, that your details and documents are accurate and yours, that machines you quote on are serviceable, and that you and your operators hold the licences, certificates and insurance the law and the job require. You are solely responsible for the accuracy of your quotes and for honouring quotes you send and bookings that follow from them.

16. Leads & conduct

Hire requests we send you are for quoting the requesting hirer through GoDig — not for building marketing lists. Don't contact hirers outside the scope of their request, don't resell or share lead details, and respond honestly (Pass beats silence — it frees the request for another company). Misrepresentation, no-shows or abuse may result in suspension or removal without refund of the current period's fee.

17. Company indemnity

Your company indemnifies GoDig (PlantLynk (Pty) Ltd, its directors and staff) against any claim arising from your quotes, your machines, your operators, your conduct of a hire, your content on the platform, or your breach of these terms — except to the extent a claim is caused by our own fraud, wilful misconduct or gross negligence.

18. Vetting documents

Documents you upload for vetting (CIPC, ID, insurance) are stored privately, used only to verify your company, and handled under our Privacy Policy. Approving a document is not an endorsement (see clause 3). You must tell us if a vetted fact changes materially (deregistration, loss of insurance you told us about).

19. Suspension & termination

We may suspend or end a membership for breach of these terms, fraud, abuse of hirers, or conduct that endangers the platform's trust — with fees for the current period forfeited in serious cases (fraud, deliberate misrepresentation). You may end your membership at any time as in clause 14. Clauses that by their nature survive (licences over published reviews, indemnities, liability limits, disputes) survive termination.
